About the Webinar:
Appraisals seem to mean different things to different people. Carriers often argue that appraisal is meant to be an easy process to determine the amount at issue in a coverage dispute. Over the years appraisals have led to numerous disputes including the scope of the appraisal, who should be involved and what communication is appropriate. Moreover, insurers had been arguing that for purpose of the Texas Prompt Payment of Claims Act, if the carrier pays the full appraisal award plus any possible statutory interest that payment precludes a recovery of attorney's fees.
That last issue will be decided by the Texas Supreme Court in Rodriguez v. Safeco. Hear what Jamie Cooper and James Willis think about Rodriguez, appraisals, attorney's fees and other issues that are frequently disputed in first party claims. We will have a frank discussion as why and when lawyers are needed to assist in claims presentment, whether fees should be rewarded and how to approach an appraisal case.
